A. A person is guilty of indecent exposure if he intentionally makes any open and obscene exposure of his person or the person of another knowing that such conduct is likely to cause reasonable affront or alarm.

B. Indecent exposure is a misdemeanor unless such person exposes himself to a person under the age of fourteen years, in which case it is a gross misdemeanor on the first offense, and if such person has previously been convicted of violating this subsection or any similar ordinance of the city of Lacey or other city, of section 9A.88.010 Revised Code of Washington or of any sex offense as defined in Revised Code of Washington 9.94A.030, state law and the penalties prescribed therein, shall prevail.
