A. The hearings examiner may grant variances to the requirements of this title. Application for a variance to this title shall be made by petition by the subdivider, stating fully the necessity of the variance based on LMC 16.90.005 and the specific requirements for which the variance is requested;

B. If a variance is in conjunction with a preliminary plat, binding site plan, or short subdivision it shall proceed in accordance with Chapter 1B of the City of Lacey Development Guidelines and Public Works Standards. A separate hearing shall be held for all other requests for variances. (Ord. 1650 §25, 2023; Ord. 1520 §65, 2017; Ord. 1235 §1, 12, 2005).
